By accessing or using Outsolvi (“the Service”), operated by Outsolvi (“we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Outsolvi is an email tracking and intelligence platform that provides open tracking, click tracking, engagement analytics, contact management, and automated sequences. The Service is available via a web dashboard, an Outlook add-in, and a Gmail extension.
3. Account Terms
- You must be 18 years or older to use the Service.
- You must provide a valid email address and accurate account information.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- One person or legal entity may not maintain more than one free account.
4. Acceptable Use
You agree not to use the Service to:
- Send unsolicited bulk email (spam)
- Track emails in violation of applicable anti-spam or privacy laws (including CAN-SPAM, GDPR, CASL)
- Impersonate another person or entity
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorized access to other users' data
- Use the Service for any illegal purpose
We reserve the right to suspend or terminate accounts that violate these terms.
5. Email Tracking Compliance
You are responsible for ensuring your use of email tracking complies with all applicable laws in your jurisdiction. This may include obtaining consent from recipients where required. Outsolvi provides the tools — you are responsible for how you use them.
6. Payment Terms
- Paid plans are billed monthly via Stripe. Prices are listed on our pricing page and may change with 30 days' notice.
- All fees are non-refundable except as required by applicable law.
- If payment fails, we may downgrade your account to the free plan after a grace period.
- You can cancel your subscription at any time through the billing portal. Access continues until the end of the billing period.
7. Intellectual Property
The Service, including its design, code, and branding, is owned by Outsolvi and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
You retain ownership of all content you create or track through the Service.
8. Data & Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described in that policy.
9. Service Availability
We strive for high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.
10. Limitation of Liability
To the maximum extent permitted by law, Outsolvi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
Email tracking accuracy depends on recipient email clients and security software. We do not guarantee that all email opens or clicks will be detected.
11. Termination
You may close your account at any time. We may suspend or terminate your access if you violate these terms or if required by law. Upon termination, your data will be deleted in accordance with our Privacy Policy.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
13. Governing Law
These terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the applicable jurisdiction.
